If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and use SpeechQuest. The Service is intended for use by parents, legal guardians, caregivers, educators, and licensed speech-language pathologists. Children may use the Service only under the direct supervision of an adult authorized account holder.
3. User Accounts
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Parent Responsibility for Child Accounts
Parents, guardians, and authorized professionals are responsible for creating and managing child profiles and for all activity conducted through those profiles. You represent that you have the legal authority to provide information about any child you add to the Service, including recordings, photos, and progress data. You are responsible for supervising the child’s use of SpeechQuest and ensuring it is appropriate for the child’s needs.
5. Acceptable Use
You agree to use SpeechQuest only for lawful purposes and in a way that does not infringe the rights of others or interfere with the operation of the Service. Acceptable use includes:
- Using the Service as a speech practice and progress-tracking tool
- Maintaining accurate and appropriate learner profiles
- Respecting the privacy and rights of children and other users
- Complying with all applicable laws and professional obligations
6. Prohibited Uses
You may not use SpeechQuest to:
- Violate any applicable law or regulation
- Impersonate any person or entity, or misrepresent your affiliation
- Upload, store, or share content that is unlawful, abusive, harmful, or obscene
- Attempt to gain unauthorized access to the Service or its systems
- Reverse engineer, decompile, or disassemble any part of the Service
- Interfere with or disrupt the integrity or performance of the Service

7. Intellectual Property
All content, software, designs, logos, trademarks, and other materials provided by SpeechQuest are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit our materials without our prior written consent.
SpeechQuest grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose in accordance with these Terms.
8. Subscription and Payments
Some features of SpeechQuest may require a paid subscription. When you purchase a subscription, you agree to pay all applicable fees and taxes. Subscription fees are billed in advance on a recurring basis according to the plan you select. All payments are non-refundable unless otherwise stated or required by law.
We may change subscription fees or introduce new charges upon reasonable notice. If you do not agree to a fee change, you may cancel your subscription before the change takes effect. You are responsible for keeping your payment information current.
9. Free Trial
SpeechQuest may offer a free trial period for new users or organizations. Free trials provide limited access to features for evaluation purposes only. When a trial ends, you must purchase a subscription to continue accessing paid features. We reserve the right to modify or discontinue free trials at any time.
10. User Content
You retain ownership of any recordings, images, notes, or other content you upload or create within SpeechQuest (“User Content”). By uploading User Content, you grant SpeechQuest a limited, non-exclusive, royalty-free license to store, process, display, and transmit your User Content solely for the purpose of providing and improving the Service.
You represent that you have all necessary rights and permissions to upload User Content, including consent from parents or guardians for any content involving children. We do not claim ownership of your clinical notes, learner recordings, or other materials.
11. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, store, and protect your information. By using SpeechQuest, you agree to the practices described in our Privacy Policy.
12. SMS Terms
Users may opt in to receive transactional SMS messages from SpeechQuest, including account notifications, verification codes, reminders, and other service-related messages. Message frequency varies based on your account activity and reminder settings.
- Message and data rates may apply according to your wireless carrier plan.
- Reply STOP to any message to unsubscribe from SMS communications.
- Reply HELP for assistance or contact us using the information below.
- SMS consent is not shared with third parties for marketing purposes.
13. Service Availability
We strive to keep SpeechQuest available and reliable, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable for maintenance, updates, or reasons beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
14. Disclaimer
SpeechQuest is an educational practice tool designed to support speech articulation practice at home, in school, and in therapy settings. It is not a medical device and does not replace evaluation, diagnosis, or treatment by a licensed speech-language pathologist or other qualified healthcare provider.
Decisions about a child’s speech or language care should always be made in consultation with a qualified professional. We make no representations or warranties that use of the Service will result in any specific clinical outcome.
15. Limitation of Liability
To the fullest extent permitted by law, SpeechQuest and its officers, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising out of or relating to your use of the Service.
Our total liability for any claim arising out of these Terms or the Service will not exceed the amount you paid to SpeechQuest in the twelve (12) months preceding the claim, or one hundred U.S. dollars (USD $100), whichever is greater.
16. Account Termination
We may suspend or terminate your account and access to the Service at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or harmful activity, or otherwise pose a risk to the Service or other users.
You may terminate your account at any time by contacting us or using the account settings available in the app. Upon termination, your right to use the Service ceases, and we may delete or anonymize your data in accordance with our Privacy Policy and applicable law.
17. Governing Law
These Terms and any dispute arising out of or relating to them will be governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of laws principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in Utah.
18. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and notify users as appropriate. Continued use of SpeechQuest after changes means you accept the revised Terms. If you do not agree to the changes, you must stop using the Service.
