Terms and Conditions

By using SpeechQuest, you acknowledge that you have read, understood, and agree to these Terms, our Privacy Policy, and any additional guidelines or policies referenced herein. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and use SpeechQuest. The Service is intended for use by parents, legal guardians, caregivers, educators, and licensed speech-language pathologists. Children may use the Service only under the direct supervision of an adult authorized account holder.

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

Children do not create SpeechQuest accounts and do not register for the Service themselves. Child profiles are created and managed by authorized adults — most often the child’s speech-language pathologist — and, in some cases, by a parent or guardian with access to the profile.

If you create or manage a child profile, you represent that you have the legal authority to do so and to provide the information you enter about that child. Before SpeechQuest will save new practice or therapy data for a child, an active adult consent record must exist for that child. Where you record that consent on a parent’s behalf as a clinician attesting to written consent obtained outside the Service, you represent that you actually obtained that consent and can produce it on request. You are responsible for supervising the child’s use of SpeechQuest and ensuring it is appropriate for the child’s needs.

You agree to use SpeechQuest only for lawful purposes and in a way that does not infringe the rights of others or interfere with the operation of the Service. Acceptable use includes:

• Using the Service as a speech practice and progress-tracking tool
• Maintaining accurate and appropriate learner profiles
• Respecting the privacy and rights of children and other users
• Complying with all applicable laws and professional obligations

You may not use SpeechQuest to:

• Violate any applicable law or regulation
• Impersonate any person or entity, or misrepresent your affiliation
• Upload, store, or share content that is unlawful, abusive, harmful, or obscene
• Attempt to gain unauthorized access to the Service or its systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Harvest or collect information about other users without consent
• Use the Service to provide medical diagnosis or treatment recommendations beyond its intended scope

All content, software, designs, logos, trademarks, and other materials provided by SpeechQuest are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit our materials without our prior written consent.

SpeechQuest grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose in accordance with these Terms.

SpeechQuest is currently offered as a free beta. Access to the Service during the beta period is provided at no charge, no subscription is required, no payment information is collected, and billing is not active. You will not be charged for beta access.

The beta is provided for evaluation purposes, and features may change, be limited, or be discontinued. We may introduce paid plans in the future. If we do, we will describe the applicable plans, fees, and billing terms before they take effect, and no charges will be applied to your account without your express consent.

Because SpeechQuest is in beta, the Service may contain defects or incomplete functionality, and features may be added, changed, or removed. We welcome feedback from beta participants through the in-app Feedback tool.

“User Content” means the notes, goals, images, custom practice words, messages, and other material you create or upload within SpeechQuest. As between you and SpeechQuest, we do not claim ownership of your User Content, including your clinical notes. You grant SpeechQuest a limited, non-exclusive, royalty-free license to store, process, and display your User Content for the purpose of operating and improving the Service.

Practice audio is handled differently and is not User Content stored by us. When a child records a practice attempt, the audio is captured locally on the device and used only for immediate playback and review during that practice moment. It is not uploaded to SpeechQuest, is not stored on our servers, is not kept as part of the child’s record, and is discarded when the practice experience ends. Only the adult-entered result or score for that attempt is saved. This is separate from any audio in SpeechQuest’s own content library, which is material we provide.

Certain records are retained even after an account closes. SpeechQuest is used to create clinical and therapy documentation. Therapy sessions and results, goals, clinician notes, consent records, legal-acceptance records, and related audit records are preserved to operate the Service, maintain accurate records, meet legal obligations, and protect data integrity. Closing or deleting an account does not automatically delete that documentation, and you may not be able to remove it from the Service or take it with you when you leave. Account deletion is a reviewed request rather than an immediate, self-service erasure. See our Privacy Policy for details.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, store, and protect your information. By using SpeechQuest, you agree to the practices described in our Privacy Policy.

Users may opt in to receive transactional SMS messages from SpeechQuest, including account notifications, verification codes, reminders, and other service-related messages. Message frequency varies based on your account activity and reminder settings.

• Message and data rates may apply according to your wireless carrier plan.
• You can turn off SMS reminders at any time in your in-app reminder preferences.
• The standard STOP and HELP keywords supported by our messaging provider and your carrier also apply.
• SMS consent is not shared with third parties for marketing purposes.

We strive to keep SpeechQuest available and reliable, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable for maintenance, updates, or reasons beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

SpeechQuest is an educational practice tool designed to support speech articulation practice at home, in school, and in therapy settings. It is not a medical device and does not replace evaluation, diagnosis, or treatment by a licensed speech-language pathologist or other qualified healthcare provider.

Decisions about a child’s speech or language care should always be made in consultation with a qualified professional. We make no representations or warranties that use of the Service will result in any specific clinical outcome.

To the fullest extent permitted by law, SpeechQuest and its officers, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising out of or relating to your use of the Service.

Our total liability for any claim arising out of these Terms or the Service will not exceed the amount, if any, you paid to SpeechQuest in the twelve (12) months preceding the claim, or one hundred U.S. dollars (USD $100), whichever is greater.

We may suspend or terminate your account and access to the Service at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or harmful activity, or otherwise pose a risk to the Service or other users.

You may request termination of your account at any time by contacting us or using the account settings available in the app. Account deletion is a reviewed request rather than an immediate, self-service erasure. Upon termination, your right to use the Service ceases. Clinical, consent, legal-acceptance, and audit records are retained as described in Section 10 and in our Privacy Policy, and other data is handled in accordance with our Privacy Policy and applicable law.

SpeechQuest does not represent that it is certified or accredited under HIPAA, FERPA, COPPA, or any similar framework, and does not currently offer a Business Associate Agreement. Clinics, schools, districts, and individual professionals are responsible for evaluating their own legal, professional, and compliance obligations before using the Service with identifiable student or patient information.

These Terms and any dispute arising out of or relating to them will be governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of laws principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in Utah.

We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and notify users as appropriate. Continued use of SpeechQuest after changes means you accept the revised Terms. If you do not agree to the changes, you must stop using the Service.
